We, AG NUTRITION INTERNATIONAL SDN. BHD. (Company No. 1321113-H), with our principal place of business at No. G-9 & 1-9, Menara Infiniti, Jalan SS 6/3, Kelana Jaya, 47301 Petaling Jaya, Selangor (collectively “AG Nutrition”), recognized that your privacy is very important to you and to most people who use the Internet and hereby committed to protecting all Personal Data kept by us and providing our customers with the highest levels of customer service. AG Nutrition is bound by the Personal Data Protection Act 2010 and all relevant regulations, standards and guidelines as may be prescribed from time to time pursuant to the Personal Data Protection Act 2010. The Personal Data Protection Act 2010 (“PDPA Act”), which applies to all companies and firms established in Malaysia, was introduced by the Government to regulate the processing of personal data in commercial transactions. The PDPA Act requires us to inform you of your rights with regards to your personal data that is collected and processed, and the purpose of such processing. It also requires us to obtain your consent to the processing of your personal data.
This policy may change from time to time and all changes will be posted here on this Website. When so posted, they shall become effective immediately. It is your duty to monitor the changes posted. We collect personal data only if you are or become a Member and we use that information mainly to help us understand your needs so that we may better service them.
This Notice applies to the processing of Personal Data by all operations and business units of AG Nutrition when you use or visit our websites, when you use or receive our products and/or services. To the extent any operations or business unit of AG Nutrition already has a specific data protection notice in place; this Notice shall supersede and replace any such notice.
This policy addresses what information we collect, how we use it, how to correct or change it, and how we protect and store it. We collect personal information and we use that information mainly to help us understand your needs so that we may better service you. The types of personal information that we may collect from you and how we use it will depend on how you use this Website.
I. Objective:
The policy aims at identifying the standard requirements on collecting, operating, maintaining, protecting, disclosure, retaining, and archiving and distributing the personal information of AG Nutrition International Sdn Bhd’ employees and Members.
II. Scope:
The policy is applicable to those who are AG Nutrition’s employees, Members, customers, public including the third parties who process these personal data in the name of AG Nutrition.
III. Definition:
“Personal Data” is any information in any format (electronic or paper) that identifies an individual in respect of commercial transaction. It includes obvious information like names, addresses and email addresses but it also includes biometric information such as fingerprints or tissue samples. If it can be used to identify or locate you – alone or with other information – then it is personal information.

3) Employment information, personal education, performance and training information
4) Spouse’s information
5) Information of family income and expense
6) Personal hobbies
Sensitive personal data consists of those elements of personal data that require extra privacy and security protections. For example, any information about a person’s health or condition of health subject, his political opinions, his religious beliefs or other beliefs of similar nature. Government issued identifiers (such as Employee Provident Fund or Income Tax numbers) are also sensitive personal data:
1) Personal information record/criminal record/ court summons record
2) Race, faith, political viewpoint, philosophical faith
3) Member of trade union
4) Health information: disease history, disability
5) Bank account information, computerized national identity card number
6) Nationality, citizenhood information

This Notice says how we respect both our employees and Member’s Personal Data interests:
We provide NOTICE to individuals about how their personal data is used.
We obtain CONSENT for the processing of personal data.
Where appropriate, we provide individuals with ACCESS, the opportunity to review and correct personal data held by AG Nutrition.
We only USE and TRANSFER personal data for AG Nutrition’s business purposes, in accordance with our Notice and applicable Malaysian laws.
We PROTECT personal data with appropriate safeguards.
The personal data processed will not be KEPT longer than necessary
How do we use your information
Your personal information may be used by us for a number of purposes including, without limitation, research and statistical analysis and marketing. In terms of marketing, from time to time we may send out promotional and marketing materials about such things as great product offers or new Website features to users who are 18 years and above.
Sharing your personal information with third parties
Unless otherwise specified or required by law or unless it is necessary for the purposes of performing services with respect to your use of this Website, we will not share your personal information with third parties, except your name, identification number, contact details and the value of the purchases you have made, will be made available to your referring or sponsoring Member, or the current Member servicing you. In addition, your Member will have access to your Member AG Nutrition username and the value of your purchase.
When necessary, your personal information may be divulged by AG Nutrition to AG Nutrition’s agents or contractors for the purpose of performing services for AG Nutrition. These agents or contractors will be prohibited from utilizing this information in any way other than to provide the services contracted for by AG Nutrition.
1. General
We collect Personal Data from you in various ways and at several different points. We may collect your Personal Data on one of our Website, by telephone, facsimile, when you complete and submit an application form to become a Member.
Wherever possible we collect Personal Data directly from you. There may, however, be occasions where we collect your Personal Data from someone else. For example, where you make an application in joint names.
If you provide Personal Data to us Member or another person, we rely on you to have made, or make them aware that you will, or may, provide their information to us and the kinds of third parties we may provide it to and the relevant purposes we and the third parties will use it for and how they can access it. If you have not done, or will not do these things, you must tell us before you provide the relevant Personal Data.
We may share the Personal Data you provide through the various means above with other AG Nutrition- related entities and/or trusted business partners with whom we collaborate, as well as those that provide services to our Website. Where we engage non-affiliated third-party agents or contractors, we require them also to observe the intent of this Notice.
From time to time, we may provide Personal Data in response to court order, subpoena, or to comply with any legal obligation; for the purpose of preventing or detecting a crime, or for the purpose of investigations; or where you have consented to such disclosure. We also reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful. We may release Personal Data when we believe that such release is reasonably necessary to enforce or apply our T & Cs or to protect the rights, property, and safety of others and ourselves.
Should AG Nutrition or its related entities merge with or be acquired by another business entity, or its respective assets be acquired, you should expect that we would share some or all of your Personal Data to companies assuming the role of serving you and other users of our Website.
In summary, we may disclose your Personal Data to third parties as follows:
to companies and organizations that assist us in the performance of our contract with you or providing you with products and/or services that you have requested or subscribed for;
to companies and organizations for compliance with any legal and/or regulatory obligations to which we are the subject to;
to companies and organizations that act as our payment channels including and without limitation, financial institutions for purposes of maintaining financial records, assessing or verifying credit/debit card details and facilitating payments of any amount due to us;

to our dealers and agents that work with us to provide or market and sell our products and/or services;

to regulatory bodies, law enforcement agencies or other government authorities in compliance with requirements under the law or towards the detection or prevention of crime and/or fraud;
to any party involved in or related to a legal proceeding, for purposes of the proceeding;
to credit providers or credit reporting agencies or fraud prevention agencies;
any third party (and its advisers/representatives) in connection with any proposed or actual reorganization, merger, sale, consolidation, acquisition, joint venture, assignment, transfer, funding exercise or asset/share sale relating to all or any portion of our business or in the unlikely event of insolvency, bankruptcy or receivership, where your Personal Data will be transferred; and/or
to any other third party related to or incidental to the performance of our contract with you, the provision of our products and/or services to you, or in respect of maintaining our business relationship with you.
2. Security
We are responsible for taking prudent steps to safeguard the confidentiality and security of all Personal Data, including taking appropriate procedural, organizational and technical steps to protect Personal Data from accidental or unlawful destruction or accidental loss, alteration or disclosure. We will employ a number of safeguards, appropriate to the sensitivity of the Personal Data, to protect Personal Data against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification.
These steps include entering into written agreements with subcontractors who process Personal Data in accordance with our instructions and incorporating our own data protection standards as a minimum, and requiring the subcontractors to provide sufficient guarantees in respect of the technical and organizational security measures governing the processing of Personal Data, and ensuring that the subcontractors take reasonable steps to comply with those measures.
3. Retention
Your data will be retained for the purposes to which it was collected and processed, or to comply with any legal, regulatory or internal requirements. We will take all reasonable steps to ensure that all personal data is destroyed or permanently deleted if it is no longer required for the purpose for which it was collected and processed.
4. Data Integrity
We strive to maintain complete, current, and accurate Personal Data about our customers. Any inaccurate Personal Data that is brought to our attention will be corrected as quickly as possible after notification. Procedures will be maintained to ensure that any reported inaccuracies are promptly and effectively handled and that all Personal Data remains as accurate, current and complete as possible.
You are obliged to provide complete, current and accurate Personal Data to us. Failure to provide complete, current and accurate Personal Data to us as required in the agreement including the registration form or any addendum to agreement/form, may result in your application for our products and/or services being rejected, the service or agreement being terminated and/or correspondence from us. In such events, we shall not be held liable for any claims or complaints from you arising therefrom.
5. Member(s)
If you are a Member, you will receive advice and information from your own personal business advisory team and support network consisting of your sponsoring Member and upline organisation. To allow such communication, we may share your contact information with your sponsoring Member and upline organisation. They have agreed not to share your information with any non-affiliated third parties and are obligated to observe the intent of this Notice. In the ordinary course of supporting your business, information about you and your orders might be shared with your sponsoring Member and immediate upline Member. You have the opportunity to let us know, however, if you do not want any Personally Identifiable Information shared beyond your immediate upline Member.
6. Your Choices
Your permission is always secured first. We will not use or share the Personal Data collected in ways unrelated to the purpose for which you provided the information, including those described above, without providing you a choice whether to permit any such unrelated uses.
7. Accessing and Correcting Your Information
We take reasonable measures to ensure that any Personal Data we collect is accurate, current, complete, and reliable for its intended use. If you wish to update or otherwise correct Personal Data you have provided to us, you may edit your information online after completing registration, or contact us as described in the “Contact Us” section, below, and we will assist you.
8. Changes To This Notice
Any updates or changes to the T & Cs of this Notice will be posted here on our Website and the date of the newest version posted below. Please check back frequently, especially before you submit any Personal Data at our Website, to see if Notice has changed. If any changes materially affect the use of Personal Data previously provided to us, we will obtain your consent prior to the retroactive application of any material changes. By using our Website, you acknowledge acceptance of this Notice in effect at the time of use.
